Definition | Programs that assist in filing affidavits of support, i.e., legally binding contracts in which the petitioning family member living in the United States agree to support the intending immigrant at over 125% of U.S. poverty level. If the petitioner does not have sufficient income to meet this requirement, other family members, household members or other sponsors may sign additional affidavits of support for the individual. The affidavits help to demonstrate that the individual is not inadmissible on the grounds that s/he will become a public charge. All family-based and employment-based immigrants who are coming to work for relatives are required to have legally enforceable affidavits of support if they file adjustment of status petitions or immigrant visa applications. |
